The 90 Day Promise
If I haven’t delivered measurable improvement to your Google Ads account within the first 90 days, I keep managing it at no management fee for up to a further 90 days, subject to the Promise Terms. You are never tied into a long contract with me either, and you can leave whenever you like, but that part is just how I work and sits separately from this promise. The promise itself is about me carrying on at my own cost until the work pays off.
That is the promise in one sentence. The terms below explain exactly what it means, what I both have to do for it to apply, and where it does not apply. These terms sit alongside the main Terms and Conditions and form part of the agreement between you and Suburbia Limited trading as PositionWorks.
1. What “measurable improvement” means
I measure improvement against your account’s starting figures, recorded when I take over. These are the numbers that matter to your business, usually one or more of:
- Wasted spend (budget going to search terms that never convert)
- Tracking accuracy (whether conversions are properly measured)
- Cost per lead (form submission or tracked phone call)
- Conversion rate
- Lead quality
Measurable improvement means a clear, measurable move in the right direction on those starting figures, compared to the 90 days prior to PositionWorks taking over. For new accounts with no previous data, the baseline is the first 30 days of my management.
I do not promise specific numbers. No agency can guarantee specific Google Ads results because click costs, competitor activity, search demand, and Google’s own auction dynamics are all outside my control. What I promise is that the trend is moving in the right direction against where your account started.
2. Your responsibilities
For the promise to apply, you need to:
- Give us full admin access to your Google Ads account, Google Analytics 4 property, Google Tag Manager container, and Merchant Center if relevant
- Allow us to install or repair conversion tracking, including phone call tracking where appropriate
- Respond to leads within a reasonable timeframe (see section 4)
- Keep your landing pages live and functional and let us know about planned changes
- Pay invoices on time so management work continues without pause
- Be available for onboarding and a mid-period review
If I cannot complete the setup because of missing access or unreturned approvals, the 90 day clock pauses until access is in place.
3. Tracking requirements
Tracking is the foundation of any promise of improvement. I cannot prove improvement without it.
You agree to allow us to:
- Set up or fix Google Ads conversion tracking
- Set up GA4 with proper events and conversions
- Install call tracking where calls are a significant part of your enquiry flow
- Install enhanced conversions where appropriate
If your tracking is fundamentally broken or unable to be fixed because of restrictions on your website (for example, you cannot install GTM, or your CMS blocks my access), and I have flagged this to you in writing, the promise is paused until tracking is working. I will tell you within the first 14 days if I believe tracking is going to be a blocker.
4. Client response time
Google Ads sends people to your business in real time. How quickly you respond to them affects whether they become customers.
You agree to respond to leads (form fills, calls, and other tracked enquiries) within 24 hours during business days. I do not require you to convert every lead. I do require you to engage with them.
If I can show that more than 50% of leads in any month went unresponded to for more than 48 hours, the 90 day promise does not apply to that period because I cannot fairly assess my management against an unworked lead pool.
Note: this 48 hour lead response window applies to leads generated by your live Google Ads campaigns and is separate from my 24 hour free audit turnaround for new prospects.
5. Ad spend
Your Google Ads spend is paid by you directly to Google. It is not part of my management fee and is not refundable by us under any circumstance.
The 90 day promise covers my management fee only. It does not cover any ad spend you have paid to Google during that period.
6. What is excluded
The 90 day promise does not apply if:
- You change your offer, pricing, opening hours, geography, or website significantly during the 90 days without telling us in advance
- Your website goes offline for more than 7 days in total during the 90 days
- You ask us to pause or reduce spend below the budget agreed at setup
- Conversion tracking is broken on your site and you do not let us fix it
- You do not respond to leads (see section 4)
- You do not pay your management fees on time
- You change your phone number, contact email, or form provider without telling us
- A major Google policy change or platform shift outside my control affects your industry (for example, a vertical being newly restricted)
- Your business is seasonal and the 90 days fall in your natural quiet period. Where this applies, we agree at the start to measure the promise across an active trading period instead, so the ads get a fair test
- Ad spend drops below the minimum agreed for your plan, starting at the Launch plan minimum. Google Ads needs enough spend to gather data and optimise, and below that floor the promise pauses until spend is restored
- Campaigns, budgets, keywords or settings are changed by anyone other than me without agreeing it first. You keep full access and ownership of your account at all times, but any impact on performance from changes made outside my management sits outside the promise
I will always tell you in writing if I believe one of these exclusions applies. I do not use exclusions to avoid accountability. They exist because there are some situations where the result is not fairly on us.
7. How it works
There is nothing to claim and no form to fill in. At the 90 day mark I review your account’s progress against its starting figures using the shared dashboards.
If the improvement hasn’t come through and the conditions in these terms have been met, I simply keep managing your account at no management fee until it does. This continues for up to a further 90 days. If the improvement still hasn’t landed by the end of that period, either of us can end the engagement with reasonable notice and no further obligation on either side.
Your ad spend is always paid by you directly to Google and is never refundable. The promise is fulfilled through my continued work at no management fee. It is not a cash refund of fees already paid.
You stay in control of your Google Ads account, conversion data, and remarketing audiences at all times. I do not lock you in.
8. If the promise is met
If the promise is met, the agreement continues as normal under the main Terms and Conditions. I keep managing the account, you keep paying the monthly fee, and I move on to the next phase of optimisation.
The 90 Day Promise is a one off, covering your first 90 days only. It is not a rolling guarantee and does not apply to any later dip or change in performance, whatever the cause. It is designed to make the start low risk so you can see what I do without the usual agency fear of being tied into a long deal.
9. Disputes
If I cannot agree whether the promise has been met, I will look at the agreed KPI data together. If I still disagree, you can ask an independent Google Ads consultant of your choice (not anyone I suggest) to review the data and make a recommendation. I agree to abide by their decision in good faith.
This clause does not affect your statutory rights as a consumer or business under UK law.
10. Changes to these terms
I may update these terms from time to time. The version that applies to you is the version that was live when you signed up. I will email you any material changes.
